Referring to the 6th. paragraph of my Despatch
No. 181 of the 22nd. May last, I have the honour to transmit for
your consideration the enclosed draft amendments of the Banishment
Ordinance under which it is suggested that power should be taken to deport persons born in the Colony but not of Eritish parentage or persons who are natives of the New Territories or were resident
there at the date of its passing under the sovereignty of Great
Britain.

Persons in these two classes are claimed when in
Chins by the Chinese Covernment as Chinese subjects, and persons in
the former class are not recognised in China by the British Govern- -ment unless they are possessors of certificates of British birth
and are registered in a British Consulate in China. In such case they are exempted from the purview of the Ordinance. Certificates
of British birth are not issued unless the applicant can satisfy
the Hongkong Authorities that he intends to reside permanently in
the Colony or in a Treaty Port. Men of the criminal class are not
likely to be able to so satisfy this Government. It seems therefore
justifiable to take the powers in the Bill.
3.
The presence in the Colony of criminals who
make the place a base for carrying out robbery and piracy on the
strength of their British nationality is becoming an increasing
danger
